Dishha Staffing Services – Terms & Conditions

Dishha Staffing Services (“Dishha,” “we,” “our,” “us”) operates as a recruitment and HR consulting service provider. By using our services, both Employers and Job Seekers agree to comply with the following Terms & Conditions.

A. Terms & Conditions for Employers

  1. Service Engagement
    • Employers engaging Dishha for recruitment or HR consulting services must sign a formal agreement/MOU before the commencement of work.
    • The scope of services (staffing, talent acquisition, payroll, etc.) will be mutually agreed upon.
  2. Job Postings
    • Employers must provide accurate, complete, and non-misleading job descriptions.
    • Dishha will not be liable for misrepresentations in employer-provided job postings.
  3. Candidate Selection
    • Dishha provides pre-screened candidates based on employer requirements, but final hiring decisions rest solely with the employer.
    • Employers must conduct their own due diligence, including compliance with labor laws.
  4. Fee & Payment Terms
    • Recruitment fees, retainer charges, or service fees must be paid as per the agreed schedule.
    • Payments are due within 10 days from invoice date. Late payments attract [X%] monthly interest.
    • Dishha reserves the right to suspend services for delayed or non-payment.
  5. Replacement Policy (if applicable)
    • If a placed candidate resigns or is terminated within [X months] of joining, Dishha may provide a free replacement, subject to conditions in the service agreement.
  6. Confidentiality
    • Employers must keep Dishha’s candidate data and internal processes confidential.
    • Data provided by Dishha cannot be shared with third parties without prior written consent.
  7. Compliance
    • Employers are responsible for compliance with all applicable labor laws, employment regulations, and workplace safety standards.
    • Dishha will not be liable for employer misconduct, wrongful termination, or workplace disputes.
  8. Non-Solicitation
    • Employers shall not directly approach Dishha’s employees for employment during or within [12 months] after the engagement.
  9. Termination of Services
    • Either party may terminate the agreement with [30 days] prior written notice.
    • Fees due until the date of termination must be cleared.
  10. Limitation of Liability
    • Dishha is not liable for losses resulting from candidate performance, misconduct, or failure to meet employer expectations.
    • Maximum liability is limited to the service fee paid for that engagement.

B. Terms & Conditions for Job Seekers

  1. Registration & Eligibility
    • Job seekers must register with accurate, up-to-date personal and professional details.
    • Dishha reserves the right to verify candidate information and reject false or misleading applications.
  2. Application Process
    • Applying through Dishha does not guarantee employment. Final selection depends on employer discretion.
    • Dishha may share candidate profiles with potential employers after obtaining consent.
  3. Data & Confidentiality
    • Candidate data is used only for recruitment purposes and shared only with relevant employers.
    • Dishha will not disclose personal information without consent, except where legally required.
  4. Career Services
    • Resume building, interview preparation, and career guidance are provided as value-added services but do not guarantee job placement.
    • Candidates are responsible for the accuracy of resumes and supporting documents.
  5. Interview & Selection
    • Candidates must attend interviews as scheduled and maintain professional conduct.
    • Failure to attend scheduled interviews without valid reason may result in suspension from Dishha’s database.
  6. No Service Fee for Job Seekers
    • Dishha does not charge candidates placement fees (unless specifically agreed for premium services such as advanced career coaching).
    • Any such charges will be transparently communicated in advance.
  7. Compliance & Conduct
    • Candidates must comply with all employer rules, ethical guidelines, and workplace regulations.
    • Dishha will not be responsible for disputes between candidates and employers post-joining.
  8. Withdrawal of Application
    • Candidates may withdraw from a hiring process by notifying Dishha in advance.
    • Dishha reserves the right to remove candidates who repeatedly withdraw after selection.
  9. Termination from Database
    • Dishha may suspend or terminate candidate access if false information, misconduct, or breach of terms is detected.
  10. Limitation of Liability
    • Dishha is not responsible for employment outcomes, compensation, or post-hiring disputes.
    • Dishha’s role is limited to facilitating recruitment opportunities.

C. General Terms (Applicable to Both Employers & Job Seekers)

  • Governing Law: These terms are governed by the laws of India.
  • Dispute Resolution: Any disputes shall be resolved through mediation first; if unresolved, disputes will be subject to jurisdiction in Hyderabad..
  • Force Majeure: Dishha is not liable for delays or failures caused by events beyond reasonable control (e.g., natural disasters, strikes, pandemics).
  • Amendments: Dishha reserves the right to amend these terms at any time.
